Terms of use, contracting and purchasing of FLOOS

FLOOS, The Crafter’s Secret (FLOOS) offers a subscription service that allows its buyers or subscribers to access floral design recipes, which are explained step by step on an Internet website through the use of texts, videos and photographs. This service is available on certain devices that have Internet connection and are compatible with FLOOS (such as computers or tablets).

The FLOOS service is owned by Carles Jubany Fontanillas, based in Barcelona, Spain, and is provided from http://www.floos.org. The terms of use, contracting and purchasing specified here govern the conditions, rights and duties of our service. For the purposes of these Conditions, the terms "FLOOS Service", "our service" or "the service" will be used to refer to the service offered by FLOOS, through which customers can access the floral design recipes created by FLOOS, including all its features and functions, the website, the texts and all the photographic and multimedia content of the floral design recipes that are included there, as well as all the associated content and the user interfaces.


1. WAYS TO ACCESS FLOOS

1.A. PURCHASE A RECIPE

1.A.1. Order confirmation

After placing your order at 'FLOOS, the crafter's secret', you will receive an email confirming that you can access the online floral design recipes you have purchased through the Floos.org website. You can access your purchased recipes unlimitedly during the entire lifetime of the page that provides the service.

If for any reason the requested content is not provided, we will refund the money paid for this service. The Administrator reserves the right at their discretion to refuse supply of the requested recipes.

1.A.2. Cancellations and returns

The return of unwanted floral design recipes will only be accepted if you request the return by writing to hola@floos.org within a 24 hour period after the moment of purchase.


1.B. MONTHLY PAYMENT SUBSCRIPTION

1.B.1. Order confirmation

After placing your order at 'FLOOS, the crafter's secret', you will receive an email confirming that you can access all the online floral design recipes available at FLOOS for the period of time that your subscription to Floos.org allows. If for any reason the requested service is not provided, we will refund the money paid for this service. The Administrator reserves the right at their discretion to refuse to provide the FLOOS service.


1.B.2. Payment and billing cycle

The subscription fee for the FLOOS service and any other charges associated with its use will be automatically renewed month by month and the amount billed will depend on the current rate at the time of renewal, and this will be charged according to the Payment Method selected during the subscription process.The billing cycle will be between 28 and 30 days starting from the calendar day corresponding to the beginning of your subscription. In some cases, the billing date may vary slightly if the renewal process is not possible on the established day.


1.B.3. Minimum contract period

When you contract the FLOOS service with the monthly payment mode, you agree to pay the service for the first three (3) monthly instalments: the fee you will pay at the time of subscribing and the two following instalments on the corresponding dates. After these first 3 months, the monthly renewal will occur automatically, but you can interrupt the service at any time by requesting its cancellation from the "My Profile" section, which you will find at http://www.floos.org, or by writing to hola@floos.org stating your wish to cancel your subscription.


1.B.4. Cancellations and refunds

In the monthly subscription mode, a cancellation with full refund will only be accepted when the cancellation is requested within a period of 72 hours after the start of your subscription. If the cancellation is requested during this period, you may ask for a total refund of your payment by writing to hola@floos.org. After this time period, you agree to pay the service for the first three (3) monthly instalments on the corresponding dates.

Once your minimum contract period is over, you can cancel your subscription to FLOOS at any time. If you do so, you will still have access to the FLOOS service until the end of your monthly billing cycle. To the extent permitted by law, monthly payments are not refundable and we do not provide refunds for partial monthly subscription periods or content of FLOOS that has not been seen or used. To cancel your subscription, go to the "My profile" section and follow the instructions for cancellation, or write to hola@floos.org stating your wish to cancel your subscription. If you cancel your subscription, it will stop renewing automatically. However, your account at FLOOS.org will remain active, in case you contract another subscription in this or another mode at a future date. If you want to close your FLOOS account permanently, you have to write to hola@floos.org expressing this wish. You can also obtain information about the billing of your FLOOS subscription by visiting your account in the "My profile" section of the website or by writing to the aforementioned email address.

If your payment information is not correctly set up or has not been properly updated and the renewal process can’t be completed because it has expired, there is an insufficient fund or for any other reason, we can suspend your access to our service until we obtain a valid payment method. When you update your Payment Method, you authorize us to continue billing you for our service using the updated Payment Method and you will remain liable for any unpaid amount. This may involve a change in the payment dates of your invoices.


1.B.5. Changes in price and service plans

We may introduce changes in our service plans and in our prices when we consider it appropriate. However, no change in price or service plan will affect you until 30 days after we notify you. These changes and updates in the price do not include variations in the price derived from specific temporary offers.


1.C. ANNUAL PAYMENT SUBSCRIPTION

1.C.1. Order confirmation

After placing your order at 'FLOOS, the crafter's secret', you will receive an email confirming that you can access all the online floral design recipes available at FLOOS for the period of time that your subscription to Floos.org allows. If for any reason the requested service is not provided, we will refund the money paid for this service. The Administrator reserves the right at their discretion to refuse to provide the FLOOS service.


1.C.2. Payment and billing cycle

The subscription fee for the FLOOS service and any other charges associated with its use will be automatically renewed year on year and the amount billed will depend on the current rate at the time of renewal. This annual fee will be charged according to the Payment Method selected during the subscription process.The billing cycle will be between 360 and 365 days starting from the calendar day corresponding to the beginning of your subscription. In some cases, the billing date may vary slightly if the renewal process is not possible on the established day.


1.C.3. Minimum contract period

When contracting the FLOOS service with the annual payment mode there is no minimum stay commitment. You can interrupt the service at any time by requesting your subscription’s cancellation at the section "My profile", which you will find at http://www.floos.org, or writing to hola@floos.org stating your wish to cancel your subscription.


1.C.4. Cancellations and refunds

In the annual subscription mode, a cancellation with full refund will only be accepted when the cancellation is requested within a period of 7 days after the start of your subscription. If the cancellation is requested during this period, you may ask for a total refund of your payment by writing to hola@floos.org.
If you cancel your subscription after this period a refund will not be possible but you will still have access to the FLOOS service until the end of your monthly billing cycle. To the extent permitted by law, monthly payments are not refundable and we do not provide refunds for partial annual subscription periods or content of FLOOS that has not been seen or used. To cancel your subscription, go to the "My profile" section and follow the instructions for cancellation, or write to hola@floos.org stating your wish to cancel your subscription.

1.D. FREE TRIAL

Occasionally, FLOOS activates promotions that allow you to try the service for free during a certain period of time. These promotions are limited to 1 free trial per user and FLOOS reserves the right to cancel access to this mode to any users deemed appropriate.

2. OUR SERVICE

2.1. What we offer

FLOOS is a 100% online library of professional floral design recipes, where prestigious master florists explain step by step, through videos and photos, how to create advanced floral design compositions. You can enjoy the FLOOS service in two different ways:

1) Purchasing a specific recipe, so you have it available in your online FLOOS account permanently, during the entire lifetime of the page that provides the service.

2) Subscribing to our website through one of the available subscription options: annual payment or monthly payment. In both options you will have access to all floral recipes and content of FLOOS during the period of time of your subscription, under the conditions established for each type of payment within this document.

In order to subscribe to the FLOOS service, you must be over 18 years old, or be considered an adult in your country or region. People under this age can only subscribe to our service with the permission of an adult.


2.2. Access to FLOOS website, The Crafter's Secret

FLOOS (http://www.floos.org) is a 100% online platform, and you can use it on different devices such as computers or tablets, but an Internet connection is always necessary

Due to the nature of the Internet, an uninterrupted service can’t be guaranteed, but FLOOS will do everything possible to ensure that the availability of the website is continuous. On rare occasions, you may not be able to access the website due to essential maintenance work. We will make sure that these periods of time are as short as possible.


2.3. Responsibility

2.3.1. Behaviour

'FLOOS, the crafter's secret' allows you to access and make personal use of this website, but not to download it or modify it except with written consent from 'FLOOS, the crafter's secret'. The resale or commercial use of this website and its content is not allowed. This includes the collections, recipe cards, lists of products, descriptions and prices; and also any misuse derived from this site or its content; any download or copy of our account information for the benefit of another merchant; or any use of data mining, robots, or similar data collection and extraction.

This website or any portion thereof may not be reproduced, duplicated, copied, sold, resold, visited or exploited for any commercial purpose without our written consent.

You must not use the website in any way that causes, or may cause, a malfunction or an interruption in our service.

It must be understood that it is you, and not FLOOS, who is responsible for all electronic communications and the content sent from your computer to us and that the website should only be used for legal purposes.


2.3.2. Fraudulent behaviour

This website must no be used for any of the following fraudulent purposes, or in connection with a crime or any other illegal activity, such as sending, using or reusing any material in a way that is illegal, offensive, abusive, indecent, defamatory, obscene or threatening; or in violation of copyright, trademark, confidentiality, privacy or any other right; or that is harmful to third parties; or objectionable; or that consists of, or contains, software viruses, political campaigns, commercial requests, chain letters, mass mailings or any "spam".


2.3.3. Opinions and external content

If you publish or release material at FLOOS, unless otherwise indicated,

(a) you grant 'FLOOS, the crafter's secret' and its affiliates and owners a non-exclusive right, free of copyright to use, reproduce, modify, adapt, publish, translate, create derivative works, distribute and display this content throughout the world in any means of communication; and

(b) you grant 'FLOOS, the crafter's secret' and its affiliates and owners, the right to use the name given to us in connection with this content, if we so wish.

The user accepts that the rights you grant here are irrevocable during the entire period of protection of your intellectual property rights related to this content and material. You agree to waive your right to be identified as the author of this content and your right to object to the treatment of this content.

If you are a master florist who collaborates with FLOOS, you agree to carry out all the necessary acts to improve any of the content provided to 'FLOOS, the crafter's secret', including the execution of works and documents, at the request of 'FLOOS, the crafter's secret'.


3. PASSWORD AND ACCESS TO ACCOUNT

3.1. Your account

If you register and use the 'FLOOS, the crafter's secret' website, you are responsible for maintaining the confidentiality of your account and password. You will also be responsible for restricting access to your computer to prevent unauthorized access to your account and you agree to accept responsibility for all activities that are performed with your account or password. You have to take every precaution to make sure that the password will be kept confidential and secure, and you must report immediately if you believe that your password has been used in an unauthorized manner.

Check that the data you provide to us during the registration process is accurate. And, please, inform us immediately of any change in the information you gave us at the time of registration. To update the information you have provided to FLOOS, visit the section 'My profile' that you’ll find at FLOOS.org.

'FLOOS, the crafter's secret' reserves the right to block users or deny them access to the website, and edit or delete content when deemed necessary.


4. PURCHASE OF PRODUCTS

4.1. Purchase of books and various floral materials

Parallel and independently to the online service of virtual recipes, you can also purchase physical products offered by FLOOS (such as books or floral materials) available at our online store.


4.2. Linked promotions

In some cases, when purchasing these products, we will offer exclusive discounts or promotions to those customers who are subscribed to FLOOS service. FLOOS reserves the right to apply and/or modify any specific conditions related to these offers, discounts and promotions.


4.3. Order confirmation

After placing your order at the FLOOS online store, you will receive a confirmation email. If, for any reason, the requested products are not provided, we will refund the money you paid for these products. The Administrator reserves the right at their discretion to refuse supply of the FLOOS products you want to purchase.


4.4. Shipments

From our online store, FLOOS sends its products worldwide. However, you will have to check the coverage of a specific country or region during the purchase process.
The cost of shipping will depend on the location of the addressee and the weight of the products, and will be communicated to you before completing your order.

4.5. Cancellations and refunds

To cancel your order totally free of charge, the cancellation must be requested within 8 hours after placing the order. After this time, if the products of the order have already been sent, the buyer will be responsible for the shipping costs that result from returning the product. The refund will only occur once the seller has received the returned products.

If, upon receiving the products, the buyer observes that the order (or part thereof) presents a visible and reasonable defect, the buyer is entitled to a refund for the amount of the order (or the part of the order that is affected) or compensation for the same value agreed between the buyer and the seller.

If you want to return an item for other reasons not related to the poor condition of the product, you will have to pay the shipping cost that results from returning the product.

Any return must occur within a maximum period of 7 days after receiving the order

5. OTHER STATEMENTS


5.1. Applicable legislation

These Terms of use, contracting and purchase will be governed and interpreted in accordance with the legislation of Spain. These conditions will not limit any protection to the consumers to which they may be entitled under the legislation in force in their country of residence.


5.2. Published materials and unrequested materials

FLOOS does not accept materials or ideas with the aim to be used as part of FLOOS service unless these materials or ideas have been previously requested. FLOOS is not responsible for any resemblance that may exist between the content or programming published in FLOOS and the materials or ideas published in other media.


5.3. Customer Support

For more information about our service or to get help with your account, FLOOS puts at your diposal the following email address: hola@floos.org. In certain cases, our Customer Service may use phone calls, social networks or other online tools to provide better assistance. These Terms of use, contracting and purchase will have priority in case of conflict with the information provided by the Customer Service or other sections of our website.


5.4. Subsistence

If any condition or conditions of these Terms of use, contracting and purchasing were declared invalid or illegal, this fact will not affect the validity, legality and applicability of the remaining terms, which will remain valid and in full effect.


5.5 Changes in the Conditions of use, contracting and purchase

FLOOS may change these Terms of Use when it deems appropriate. These changes will be notified at least 30 days before the new Terms of Use are applicable. These changes and updates do not include variations in the price derived from specific temporary offers in the service.


5.6. Electronic communications

FLOOS will send you information about your account (such as payment authorizations, invoices, changes to your password or payment method, confirmation messages, advertisements) in electronic format; for example, through your email, to the address provided during the registration process.


5.7. Privacy policy and data protection

In compliance with the LO 15/1999 of Protection of Personal Data, we inform you that the contact data that you have provided at the time of your registration or subscription is incorporated into a file, property of Carles Jubany Fontanillas, and that this will only be used for the purpose of making our commercial relationship possible and / or to allow future communications. You have the right to request access, modification or cancellation of your data, including your email address, from our file.
